ACCEPTABLE USE POLICY
- Introduction.
Our customers' success is the driving force behind Barrett Web Services. Barrett Web Services offers its customers website hosting, web design, and other services (herin refered to as "Services"). For the purpose of this AUP, Barrett Web Services refers to the company Barrett Web Services and any suppliers of technical services to Barrett Web Services that are resold to Customers. Barrett Web Services respects Customers' rights and the free and open communications that the Internet provides. In order to protect its customers' rights and to comply with legal and ethical standards, Barrett Web Services has established this Acceptable Use Policy ("AUP") as a supplement to other customer and user agreements. From time to time, this AUP may be revised. All revisions will be posted to http://www.barettwebservices.com. Continued use of Barrett Web Services' products and services after changes have been posted to the Barrett Web Services' website constitute the customer's and user's acceptance of any new or additional terms of the AUP.
- General.
The Internet is provides open and free communications with few controls. Users are responsible for using their own judgment when for information they acquire and/or information they disseminate to others. Barrett Web Services cannot monitor, verify, warrant, or vouch for the accuracy and/or quality of the information disseminated over the Internet. Users must also be aware that some material posted to the Internet is sexually explicit and/or otherwise offensive. Barrett Web Services accepts no responsibility for injury to its users, customers, or subscribers that results from inaccurate, unsuitable, offensive, or illegal Internet communications. Additionally, Barrett Web Services accepts no responsibility for any inaccurate, unsuitable, offensive, or illegal Internet communications disseminated by its users, customers, or subscribers. When people, including but not limited to users, customers, and subscribers, place information on the Internet, they assume complete liability for copyright infringement, defamation, and other harmful speech. When users, customers, and subscribers post information to the Internet using Barrett Web Services' network and/or the network of Barrett Web Services' suppliers, the information is disseminated to a large number of people, including but not limited to users, customers, subscribers, and non-subscribers of Barrett Web Services. Such information may affect other customers and subscribers and may harm Barrett Web Services reputation, goodwill, and/or operations. Therefore, when customers and/or subscribers, their employees, customers, affiliates, or subsidiaries engage in activities described herin, they violate Barrett Web Services' policy.
- Purpose.
The purpose of this AUP is to protect Barrett Web Services' customers and users of the Internet from illegal, unethical, irresponsible, or otherwise disruptive activities. This AUP applies to customers, subscribers, and other users of Barrett Web Services, including customers' employees, agents, contractors, and/or other users of services that customers obtained from Barrett Web Services. All of the aforementioned are included in the term "Users" in this AUP.
- Prohibited Uses.
Users are prohibited from the following activities and practices. When a prohibited activity or practiced is detected, Barrett Web Services has sole discretion in evaluating the evidence to determine if a violation of this policy occurred.
- Sending Unsolicited Messages (spamming).
Users may not utilize Services to send unsolicited bulk and/or commercial messages over the Internet. This does not prohibit the use of "opt-in" email lists.
- Illegal Activities.
Users may not utilize Services in connection with any illegal activity. Illegal activities include, but are not limited to:
Copying material from third parties without authorization.
Infringing on patents, copyrights, trademarks, and/or other intellectual property rights of third parties.
Trafficing illegal, illegal gambling, obscene materials, or other products and/or services that are prohibited under applicable law.
Exporting encryption software to points outside the United States in violation of applicable export control laws and/or regulations.
Forging or misrepresenting headers, URLs, or other identifiers, in whole or part, in order to mask the originator of the message.
Any manner that violates applicable law.
- Disruptive and Abusive Behavior
Users may not utilize Services in connection with any disruptive or abusinve activity. Disruptive and abusive activities include, but are not limited to:
Publishing or disseminating information that constitutes slander, libel, or defamation.
Publishing or disseminating the personal information or likeness of a person with that person's consent.
Violating the privacy rights of any person.
Threatening persons with bodily harm, making harassing or abusive statements or messages, or soliciting the performance of acts or services that are illegal under applicable law.
Any other abusive or abusive activity.
- Other Prohibited Behavior
Users may not utilize Services to:
Cause denial of service attacks against Barrett Web Services, its suppliers, other network hosts, and/or other Internet users.
Impair or degrade the operation of Barrett Web Services' or its suppliers' servers and facilities or the servers and facilities of other network hosts or Internet users.
Post messages of software programs that require excessive CPU time or storage space.
Offer mail services, mail forwarding capabilities, POP accounts, or auto responders other than for the User's own account.
Resell access to CGI scripts installed on Barrett Web Services' or its suppliers servers.
Subvert, or assit others in subverting, the security or integrity of any Barrett Web Services systems, facilities, and/or equipment, including those of Barrett Web Services' suppliers.
Gain unauthorized access to the computer networks of Barrett Web Services, its suppliers, or any other person.
Provide passwords or access codes to persons not authorized to receive such information by the operator of the system requiring the password or access code.
Forge the signature or other identifying mark or code of any other person, impersonate or assume the indentity of any other person, or engage in any other activity to attempt to deceive or mislead other persons regarding the true identity of the User. The use of anonmymous re-mailers or Internet nicknames is not prohibited by this provision.
Distribute or post any virus, worm, Trojan horse, or computer code intended to disrupt services, destroy data, destroy or damage equipment, or disrupt the operation of Services.
Conduct port scans or other invasive procedures against any server except those for which the User is an authorized System Administrator.
Distribute, advertise, or promote software or services with the primary purpose of encouraging or facilitating unsolicited bulk commercial e-mail or spam.
Solicit, collect, distribute, advertise, or promote e-mail address lists for the purpose of encouraging or facilitating unsolicited commercial e-mail or spam.
Use Services in any manner that might subject Barrett Web Services or its suppliers to unfavorable regulatory action, subject Barrett Web Services or its suppliers to any liability for any reason, or adversely affect Barrett Web Services' or its suppliers public image, reputation, or goodwill.
Sending, posting, or distributing sexually explicit, hateful, vulgar, racially ethnically, or otherwise objectionable materials as determined by the sole discretion of Barrett Web Services.
Utilize the Services in any other manner to interrupt or interfere with the Internet usage of other persons.

Barrett Web Services expressly disclaims any obligation to monitor its Users, including customers, subscribers, non-subscribers, and other users, with respect to violations of this AUP. Barrett Web Services assumes no liability or responsibility for the actions of any of its Users or any content any User may post, distribute, or otherwise disseminate on any website, through e-mail, or by any other means.
- Reporting Violations
Barrett Web Services encourages users to report violations of this policy by e-mail to: ABUSE@BARRETTWEBSERVICES.COM. Please include in any such report the name of the offending domain and the type of abuse in the "subject" field of the e-mail.
- Remedies
If Barrett Web Services learns of a violation of this AUP, Barrett Web Services will respond to the applicable User. Barrett Web Services reserves the right to take any of the following actions, in accordance with the severity and duration of the violation and at the sole discretion of Barrett Web Services:
Warning the User.
Suspending the offending User from Services.
Terminating the offending User from Services.
Imposing fees or charges on the offending User account in accordance with the applicable service contract.
Taking other action in accordance with this AUP, the applicable service contract, and/or applicable law.
If a User's service is terminated under this provision, the User agrees to forfeit any and all moneys paid at the time of termination in accordance with applicable laws and service contracts.
- Disclaimer
- Reservation of Rights.
Barrett Web Services reserves the right to cooperate with appropriate legal authorities in investigations of claims of illegal activity involving Services, Customers, Subscribers, and other Users. Barrett Web Services reserves all other rights to respond to violations of this AUP to the extent of applicable law and in accordance with any applicable contractual obligations. Barrett Web Services may utilize technical means to monitor communications into, and out of, its network facilities to prevent the introduction of viruses or other hostile code, to prevent intrusions and otherwise to enforce this AUP. Each Customer and User of Services agrees that Barrett Web Services and suppliers of technical services to Barrett Web Services are authorized to monitor its communications through Barrett Web Services' and/or the supplier's network for such purposes.
